A las 00:30 del día martes 27 de agosto, personal policial de la comisaría tercera de la ciudad de Río Grande recibió un aviso alertando sobre un robo que en esos momentos se estaba perpetrando en el sector del depósito del supermercado Carrefour, ubicado en calle Perú N° 76. Al arribar al lugar, los efectivos policiales encontraron en el exterior del establecimiento a David Ángel Álvarez, de 32 años de edad y a Hugo Nicolás Castillo, de 22 años; en el interior, a Brandon Gabriel Vitolo, de 24 años y en las inmediaciones, a José Gonzalo Zuñiga Ojeda, de 41 años y a Víctor Alejandro Ojeda Ojeda, de 45 años, en un automóvil Volkswagen Gol de color rojo, en marcha, adonde iban acopiando la mercadería sustraída. Los cinco sujetos fueron aprehendidos y puestos a disposición del Ministerio Público Fiscal, quien dispuso las actuaciones correspondientes por el delito de hurto en grado de tentativa.
La mercadería recuperada incluía 216 latas de cerveza de 473 cm³ en el predio del supermercado; 169 latas de cerveza de 473 cm³, una bolsa con medallones de carne, fiambre y tapas de empanadas en el exterior del depósito y 48 latas de cerveza de 473 cm³, en el baúl del vehículo.
Debido al aliento etílico que exalaban los detenidos, se le realizó un test de alcoholemia, resultando que José Zuñiga Ojeda tenía 1,22 gramos de alcohol en sangre; Víctor Ojeda Ojeda, 1,69 g/L; Brandon Vitolo, 0,83 g/L; Hugo Castillo, 0,86 g/L y David Álvarez, negativo.
Debido a la falta de documentación del vehículo y al resultado positivo del test de alcoholemia de su conductor, se procedió al secuestro del Volkswagen Gol. Paradójicamente, el rodado conteniendo el botín sustraído hasta el momento de ser sorprendidos los ladrones por los policías, estaba estacionado con su motor encendido, en la calle “Policía Fueguina”.
