El Consejo de la Magistratura resolvió correr traslado al Fiscal Acusador para que resuelva si se da inicio o no a un proceso de enjuiciamiento al juez de Instrucción de Río Grande, Daniel Cesari Hernández, donde se investiga el cuestionado desempeño del juez para con su personal.
Cabe recordar que el 13 de marzo, el gremio de la Unión Empleados de Justicia de la Nación, inició una protesta frente a las oficinas del Juzgado de Instrucción N°1 en relación a denuncias por “violencia y acoso laboral”.
Allí, el gremio aseguró que inmediatamente luego de haber tomado conocimiento de casos de maltrato a agentes judiciales, funcionarios y auxiliares de la justicia, decidieron actuar, con la intención de dar a conocer la situación que se vive en Río Grande y las autoridades del Superior Tribunal de Justicia tomen cartas en el asunto.
Los reclamos rápidamente hicieron eco, por lo que desde el propio STJ se dispuso llevar adelante una investigación, la cual derivó en que la jueza Cecilia Cataldo (a cargo de la investigación), dispusiera notificar de Derechos y Garantías Procesales al magistrado Cesari Hernández al imputarlo de los delitos que se atribuían.
Ante esta situación, se dio intervención al Consejo de la Magistratura, órgano encargado de la designación y remoción de funcionarios y magistrados, que por votación unánime de los presentes en la sesión, se aprobó correr traslado de las actuaciones al Fiscal Acusador, en este caso ejercido por el representante del Colegio de Abogados de la ciudad de Río Grande, Abdo González Saber, en relación a la Ley Provincial 525, la cual establece el inicio del proceso de “Enjuiciamiento de Magistrados y Funcionarios del Ministerio Público del Poder Judicial” de Tierra del Fuego.
Dentro de los primeros pasos que se han llevado adelante desde el Consejo de la Magistratura, se brindaron detalles en relación a la investigación sumaria de los hechos denunciados en contra del juez de Instrucción Cesari Hernández dentro de lo que establece el artículo 10 de la Ley Provincial 525. Al ser analizado por los miembros del Consejo y al no encontrar pruebas sobre una denuncia infundada o irrazonable, por unanimidad, se dispuso correr traslado de las actuaciones al Fiscal Acusador que actuará como órgano de acusación.
A partir de ahora, el Fiscal Acusador será el encargado de formular la acusación, acompañando las pruebas documentales, como así también, ofrecer los demás medios de prueba en un plazo no mayor a 20 días a partir de la notificación formal de la decisión del Consejo, o bien no formular tal acusación. Sin suspensión: Si bien hasta el momento el juez Cesari Hernández fue notificado de Derechos y Garantías Procesales, continúa en sus funciones con total normalidad.
Una situación que llamó poderosamente la atención dentro del ámbito del Poder Judicial, dado que parte de la “violencia y acoso laboral” por el cual el gremio solicitó al STJ una rápida resolución, son trabajadores del propio juzgado, por lo que desde marzo, continúan bajo las órdenes del magistrado, como así también los auxiliares de la justicia y funcionarios que deben convivir a diario con el denunciado. El Superior Tribunal dispuso iniciar una investigación y el Consejo de la Magistratura dio avance a la causa, la cual podría recaer en la destitución del magistrado.
Asimismo, aún se desconoce los motivos por los cuales no se llevó adelante una posible suspensión o apartamiento provisorio del juez hasta tanto se defina su futuro en el Consejo, suspensión que se encuentra estipulada dentro de la Ley Provincial 525.
