La Cancillería de Argentina ha presentado una protesta formal en respuesta a la creación de un mapa por parte de la Armada de Chile, en el cual se delinean áreas marítimas del país vecino que coinciden con zonas pertenecientes a Argentina.
La queja fue formalizada el jueves pasado, cuando la Cancillería argentina presentó una comunicación ante la embajada chilena en territorio argentino, según se reportó en el día de hoy.
El «Gráfico Ilustrativo de los Espacios Marítimos de Jurisdicción Chilena» fue divulgado por el Servicio Hidrográfico y Oceanográfico de Chile el 23 de agosto, mostrando una supuesta plataforma continental chilena que se superpone con una sección de la plataforma continental argentina.
La Argentina rechazó este gráfico (24 horas después de su publicación) por medio de una nota diplomática (Nota Suala 35/2023) dirigida a la República de Chile, según indicaron fuentes dentro de la Cancillería a la agencia Télam.
El «Gráfico Ilustrativo» en cuestión no aborda una cuestión novedosa, sino que busca representar los espacios marítimos bajo la jurisdicción chilena, de acuerdo con el Decreto Supremo N°95 publicado el 27 de agosto de 2021. Además, busca ilustrar la presentación realizada por Chile ante la Comisión de Límites de la Plataforma Continental bajo el nombre de «Plataforma Continental Occidental del Territorio Antártico Chileno», agregaron las fuentes.
Desde que surgió la controversia, la Argentina ha rechazado la pretensión chilena en numerosas ocasiones, tanto a nivel bilateral como multilateral, por medio de intercambios diplomáticos dirigidos al Secretario General de las Naciones Unidas y al Secretario General de la Autoridad Internacional de los Fondos Marinos, de acuerdo con el Comunicado Nº 344/21 del 28 de agosto de 2021.
El Tratado de Paz y Amistad entre Argentina y Chile, suscrito el 29 de noviembre de 1984 en Roma por el entonces Canciller argentino Dante Caputo y su homólogo chileno Jaime del Valle Alliende, resolvió de manera definitiva e inquebrantable todas las disputas marítimas entre ambos Estados. La pretensión chilena contradice el espíritu y el texto de dicho acuerdo.
De acuerdo con el Resumen Ejecutivo de la presentación efectuada por Argentina ante la Comisión de Límites de la Plataforma Continental (CLPC) en 2009, la demarcación del límite de la plataforma continental argentina se ajusta plenamente a las normativas de la Convención de las Naciones Unidas sobre el Derecho del Mar y el Tratado de Paz y Amistad de 1984.
El mapa en cuestión, que ha suscitado la controversia, fue elaborado por el Servicio Hidrográfico y Oceanográfico de la Armada chilena y abarca un área de aproximadamente 5.000 kilómetros cuadrados al sur del Mar de Drake y de las Islas del Cabo de Hornos, situándose sobre el territorio marítimo argentino.
