El fiscal Diego Luciani adelantó que pedirá que la vicepresidenta Cristina Fernández de Kirchner y el resto de los exfuncionarios imputados en la causa por la obra pública en Santa Cruz sean inhabilitados de forma perpetua para ejercer cargos públicos.
El fiscal lo sostuvo en el marco del final de su alegato ante el Tribunal Oral Federal (TOF) 2 en el juicio en el que se investiga el supuesto direccionamiento de la obra publica vial en Santa Cruz entre 2003 y 2015.
Los fiscales Luciani y Sergio Mola darán a conocer este lunes el pedido de penas para los acusados, entre ellos la vicepresidenta Cristina Kirchner, por presuntas irregularidades en la obra pública en la provincia de Santa Cruz entre 2003 y 2015.
El tramo final de la novena y última jornada de alegato tiene previsto resumir de manera compactada lo que ambos representantes del Ministerio Público desgranaron en las oportunidades anteriores, realizar una evaluación político-judicial y culminará con el pedido de penas, que se insinúa particularmente alto en el caso de los principales imputados.
Voceros del Tribunal Oral Federal que lleva adelante el debate estimaron que por la forma en que está estructurada la audiencia de hoy, el pedido de penas podría conocerse en torno a las 18.
Después de los alegatos de la acusación comenzará la ronda de las defensas, cuyo organigrama no está aun definitivamente establecido.
Si bien la disposición original indicaba que los abogados defensores alegarían por orden alfabético, ese esquema puede alterarse por pedido de las parte y con la autorización del tribunal.
Fiscal Mola: «No es creíble que Cristina Kirchner no se enterara de nada”
En el comienzo de la audiencia, y en rechazo a la defensa de Abel Fatala, exsubsecretario de Obras Públicas, el primer fiscal en tomar la palabra fue Sergio Mola. “Tomó efectivo conocimiento de la maniobra defraudatoria que se estaba cometiendo en Santa Cruz y optó por no ejecutar las tareas de control que tenía asignadas”, apuntó y, en ese sentido, afirmó que “a esta altura no es creíble que no tuviera conocimiento, como no es creíble que Cristina Kirchner no se enterara de nada”.
De acuerdo a Mola, Fatala tuvo un manejo de la obra pública vial de Santa Cruz que no habían tenido sus predecesores y que no podía desconocer las alertas que recibió y debió haber atendido. También citó a José López sobre el “ya célebre dinero que arrojó al convento” y recordó la frase en la que dijo: “Ese dinero no me pertenecía. Ese dinero pertenecía a la política”. Fue el 11 de agosto de 2016.
Por último, el fiscal también abordó el homicidio de Fabián Gutiérrez, exsecretario privado de la vicepresidenta, en julio de 2020 en El Calafate. Recordó los dichos de López sobre él en la causa de los cuadernos de las coimas, en la que lo sindicó como “recaudador” y dijo que “era funcional a los dos”, a Néstor y a Cristina Kirchner. “Si me llamaba Fabián era porque Cristina se lo había ordenado. Fabián era Cristina”, había dicho López.
El fiscal coadyuvante Sergio Mola inició su descripción final apuntando al ex secretario de Obras Públicas José Francisco López y a su subordinado Abel Fatala, y de inmediato pasó al empresario Lázaro Báez.
Luego retomó la descripción para el resto de los imputados para desembocar en el perjuicio que causó el mecanismo ilegal denunciado.
De eso se encargó, en la sucesión de intervenciones, el fiscal Mola, quien cuantificó en 5.321 millones de pesos.
Tras un cuarto intermedio de media hora, retomó Luciani –en la antesala inmediata del pedido de penas- aclarando que uno de los imputados, Carlos Santiago Kirchner, será acusado por “incumplimiento de los deberes de funcionario público”, acaso la imputación más leve de todas las que se insinúan hacia el final de la exposición.
