Nelson Martínez, de 38 años de edad, fue condenado por haberle arrojado con furia un teléfono celular a la cara a su pareja, provocándole la destrucción del globo ocular y de haber golpeado con el puño el rostro de su hijo de 12 años, cuando éste intentaba defender a su madre.
Los jueces Maximiliano García Arpón, Alejandro Pagano Zavalía y Rodolfo Bembihy Videla condenaron el viernes último a Nelson Martínez, a la pena de 7 años de prisión al encontrarlo responsable del delito de lesiones leves agravadas por el vínculo, en concurso real con lesiones leves y lesiones graves, doblemente agravadas por el vínculo y por violencia de género y amenazas.
Los hechos juzgados por el Tribunal de Juicio en lo Criminal del Distrito Judicial Sur
ocurrieron durante la pandemia de 2020; en el año 2021; entre agosto y septiembre de 2022 y el 3 de diciembre de este último año en Ushuaia, en perjuicio de quien fuera su pareja y su hijo menor de edad. El sujeto es un alcohólico violento que maltrataba permanentemente a su pareja y a su hijo, llegando al colmo de su repudiable accionar cuando el año pasado, en medio de una discusión con su conviviente, quien le reprochaba una infidelidad, le arrojó a la cara un teléfono celular causándole el estallido del globo ocular. En la misma ocasión golpeó con el puño a su hijo de 12 años en la cara, quien intentó interceder para que no continuara agrediendo a su madre. A causa de la lesión sufrida a la mujer se le debió posteriormente extirpar el ojo.
Al momento de las agresiones el individuo, de ocupación estibador portuario en Ushuaia, se encontraba en el domicilio familiar, en el barrio de Andorra.
Durante la instancia de alegatos, la fiscal de Violencia de Género e Intrafamiliar y Asistencia a las Víctimas del DJS, la abogada Paula Schapochnik, solicitó una pena de 7 de años de prisión por los delitos de lesiones leves agravadas por haber sido cometidas por un ascendiente a su descendiente, ello en concurso real con el delito de lesiones graves agravadas por el vínculo y por mediar violencia de género, lesiones leves y amenazas con arma. Esto último se debe a que Martínez en al menos una ocasión amenazó con un cuchillo a su pareja.
Schapochnik mencionó como agravantes la disminución del sentido de la vista que sufrió la mujer al perder un ojo, el daño extensivo a todo el grupo familiar y que el imputado no expresó arrepentimiento, entre otros, y como atenuante que no tenía antecedentes penales anteriores.
Por su parte, el abogado defensor Carlos González Medina sostuvo que cuando su defendido no ingiere bebidas alcohólicas, “es tranquilo”, así como indicó que el relato de las víctimas, la mujer y el niño, fueron “contradictorios”, por lo que solicitó la absolución para Martínez.
Luego y en el colmo de la sinverguenzura, en la etapa de últimas palabras antes de la sentencia, el hombre manifestó que “siempre traté y cuidé bien a mi familia”.
Los fundamentos de la sentencia se conocerán el 1 de septiembre, a partir de las 19.
