Este día, el Tribunal de Juicio en lo Criminal del Distrito Judicial Norte condena a María Adela Calchaquí a la pena de dos años de cumplimiento en suspenso por el delito de uso de instrumento público falso y defraudación al Estado.
“Calchaquí fue condenada al haberse comprobado que presentó un certificado de título secundario en trámite que era apócrifo pero que le permitió percibir un ítem salarial durante al menos una década” (El Diario del Fin del Mundo, 2/11/2014).
Tiempo después, la ex diputada presentó su título universitario, con la intención de incorporarse al escalafón profesional del Gobierno provincial. Sin embargo, al momento de requerírsele que cumplimentara con la entrega del título secundario, Calchaquí dijo primero que contaba con dicho diploma para luego negar que ella hubiera presentado certificado de título en trámite alguno”.
Asimismo, los jueces consideraron un agravante el testimonio de una ex empleada “del área de Recursos Humanos del Gobierno fueguino, quien develó que oportunamente recibió un llamado de alguien que se habría identificado bajo el nombre de Mariel Calchaquí y que le solicitaba hiciera desaparecer del expediente cualquier documentación que la comprometiera”.
Al hacer uso de la palabra ante el tribunal, minutos antes de conocerse la sentencia, Calchaquí reconoció su error, pero consideró exagerado y excesivo el pedido del fiscal.
“Al momento de leerse el fallo condenatorio Calchaquí se mostró inmutable, conservando el mismo rictus que exhibió a lo largo del breve proceso que tan solo duró 48 horas y que terminó condenándola a dos años de prisión en suspenso”.
Tres años después, el Superior Tribunal de Justicia declaró extinguida por prescripción la acción penal impulsada contra Calchaquí por el delito de fraude contra la Administración Pública. La corte “evaluó el tiempo transcurrido entre la supuesta comisión del hecho (febrero de 1990) y la citación a indagatoria de la imputada, teniendo en cuenta que la denuncia se realizó 21 años después del hecho (en abril de 2011)” (InfoJudicial TDF, 28/11/2017).
María del Carmen Battaini “votó en disidencia, al considerar que como la cuestión no fue planteada por la defensa, no fue abierta a prueba y alegaciones”.
Cabe señalar que “la imputada había suscripto un convenio con el estado Provincial por el cual abonó las sumas dinerarias supuestamente mal recibidas” (InfoJudicial).
