El abogado penalista Raúl Paderne, que patrocina la defensa del sindicalista Ramón “Moncho” Calderón, secretario general de la UTHGRA, en una causa por presunto encubrimiento, indicó que apelará el procesamiento de su defendido.
Cabe recordar que el juez de grado dictó el procesamiento, sin prisión preventiva, de Calderón.
Para Paderne, la decisión del magistrado está dentro de la lógica jurídica. “El delito de encubrimiento tiene una pena máxima de 3 años y por lo tanto es susceptible de tener una supuesta condena condicional, si llegare el caso, entonces la hipótesis de la detención o de la prisión preventiva que podía regularizar esa situación no hubiese sido un acto jurisdiccional defendible”, opinó.
En cuanto a la apelación que encarará, mencionó que no descarta ninguno de los métodos alternativos que están dentro de las posibilidades de la defensa, como por ejemplo la mediación o la probation.
Por otra parte, remarcó que los casos de Calderón y Perpetto, irán por carriles separados ya que se trata de “dos calificaciones delictuales distintas por lo cual cada una de las defensas seguirá su propio camino”.
“En nuestro caso el procesamiento ya lo limita a Calderón de la posibilidad de comisión de otro ilícito, lo sobreseen a Calderón por amenazas también. Entiendo que las defensas van a ir en forma individual. No veo cuestiones que se toquen. Se están analizando tres ilícitos distintos respecto de dos personas distintas”, agregó.
En cuanto a Calderón, si bien no se dictó la prisión preventiva, éste tiene que cumplir medidas que hacen a la presentación semanal ante la Justicia y dar aviso en caso de que necesite viajar para salir de la provincia, cuestiones que están dentro de las obligaciones de cualquier persona que está sometida a un proceso penal. “Su vida va a transitar normalmente porque en definitiva toda persona puede estar sospechada de un delito pero el principio de inocencia no cede. Si llegare el caso de un juicio veremos pero por el momento la presunción de inocencia es a su favor y así pretendemos sostenerla”, señaló Paderne.
Por último, dijo que el plazo para apelar el procesamiento es de cinco días hábiles y consideró que la Cámara no resolvería la apelación antes de la feria judicial.
