La Cámara de Diputados aprobó la Ley de Alquileres con los cambios impulsados por el kirchnerismo desde el Senado. Los contratos entre propietarios e inquilinos se mantendrán por tres años y tendrán una actualización semestral. Rechazaron la iniciativa los libertarios, Juntos por el Cambio y algunos legisladores provinciales.
La propuesta fue sancionada en la madrugada de este miércoles por 128 votos a favor y 114 en contra en una sesión maratónica que comenzó el martes al mediodía.
El Frente de Todos dio vuelta lo votado en agosto pasado y logró ratificar lo aprobado en el Senado con el apoyo de dos diputados del Interbloque Federal, uno de Juntos por Rio Negro y los cuatro representantes del Frente de Izquierda, mientras que Javier Milei, Juntos por el Cambio y algunos legisladores provinciales rechazaron la propuesta.
De esta manera, el kirchnerismo ratificó los 3 años de los contratos, tal como establece la normativa actual, pero baja de 12 a 6 meses el plazo de actualización.
También se dispone como mecanismo de indexación al coeficiente Casa Propia que publica el ministerio de Desarrollo Territorial y Hábitat en los planes Procrear II. Este índice toma el menor indicador entre el promedio de la variación salarial del último año y el promedio de la inflación del mismo periodo.
Además se puntualizó en el proyecto que en los contratos de locación de inmuebles con destino a uso habitacional, el precio del alquiler debe fijarse «en moneda nacional y por períodos mensuales».
De esta manera, intenta frenar los contratos en dólares y el pago anticipado. Los ingresos provenientes de contratos de locación de hasta dos inmuebles estarán exentos del pago del Monotributo.
Las partes podrán deducir del Impuesto a las Ganancias la suma equivalente al 10 % del monto anual del contrato de locación.
Para que la reforma aprobada entre en vigencia formalmente, es necesario publicarla en el Boletín Oficial, un proceso que podría tomar alrededor de 40 días. Hasta que esto ocurra, los contratos seguirán siendo de tres años y se ajustarán anualmente a través del Índice de Contratos de Locación (ICL).
