En la segunda jornada del juicio oral por el asesinato de la estudiante riograndense, declararon la madre, el padre y el hermano de la víctima. Los tres repasaron dramáticos sucesos de la etapa en que estaban de novios.
La madre de Marianela Rago Zapata, la joven hallada degollada y con 23 puñaladas en un departamento del barrio porteño de Balvanera en junio de 2010, calificó al exnovio y único imputado por el homicidio de su hija como «un psicótico» y recordó que la víctima le confesó que mantenía reiteradas peleas con el acusado porque le molestaba «que tuviera una vida nueva» y en una oportunidad hasta la amenazó y le dijo que «no iba a poder volver a dormir tranquila».
Patricia Zapata, madre de Marianela (19), declaró esta tarde en la segunda audiencia del juicio por el homicidio de su hija ante el Tribunal Oral en lo Criminal (29) porteño, frente a la mirada de Francisco Amador (36), quien enfrenta una acusación como autor del delito de «homicidio simple».
En la jornada también declararon Eduardo Rago y Matías Rago Zapata, padre y hermano, quienes pidieron que el único imputado por el crimen no esté presente durante sus testimonios.
Patricia Zapata recordó en su testimonio el último año de secundaria de su hija, etapa en que conoció a Amador, quien era su preceptor en una escuela de la ciudad fueguina de Río Grande.
“Era su pareja. No recuerdo que me lo haya presentado oficialmente”, aseguró la mujer, quien recordó que su hija viajó con Amador hacia Buenos Aires en 2009, cuando la joven comenzó a estudiar periodismo.
Frente a los jueces Hugo Navarro, Juan María Ramos Padilla y Rodolfo Goerner, la mujer relató que una de las primeras advertencias que le hizo su hija sobre la relación con Amador fue entre junio y agosto de ese mismo año en que Marianela llegó a Buenos Aires, cuando la llamó llorando y le contó que había discutido con el imputado.
“Me llamó llorando, que se había peleado con Amador, que le había gritado y que le dijo que ‘nunca más iba a poder dormir tranquila’. Lo llamé a él, le dije de todo y que nunca más se acerque a Marianela”, dijo Zapata.
La mujer aseguró que con su esposo hablaron sobre la posibilidad de solicitar una orden de restricción de acercamiento de Amador hacia su hija, pero que al día siguiente Marianela los llamó y les dijo que “estaba bien, que había hablado con su pareja y que habían terminado la relación y no se iban a ver más”.
Para la madre de Marianela, Amador “no toleraba que Marianela esté acompañada, ni siquiera con amigas” y recordó una situación violenta cuando el joven le recriminó a su hija frente a ella que no le respondía los mensajes.
“El seguimiento de esta persona (por Amador) era constante. Siempre la llamaba”, indicó, tras lo cual lo calificó como «un psicótico”: «Si él no la tenía a ella, no la tenía nadie”, dijo.
Luego, emocionada, la mujer recordó a su hija como «una chica feliz, que le gustaba bailar, salir, y cuando estaba con él era otra, no era ella”.
Patricia Zapata se refirió también al hecho en que su hija fue hallada muerta en el departamento que alquilaba en el barrio porteño de Balvanera, y apuntó directamente a Amador.
“No creo que haya sido un robo, creo que él la siguió. No hay crimines perfectos, yo creo que él fue, él la siguió, que le molestó que tuviera una nueva vida. Marianela no se merecía esto”, dijo la mujer, mientras su hijo Matías como su marido Eduardo rompieron en llanto, por lo que fueron abrazados y contenidos por sus allegados.
“La muerte de Marianela fue terrible, fue un antes y un después. Una parte de uno que se va y no vuelve más. Era mi chiquita y no la tuve más. La extrañamos mucho”, añadió la mujer, quien dijo que espera que en este debate “surja la verdad y poder darle un cierre”.
“Fueron 13 años hablando de esto, sin poder terminar de cerrar lo que pasó con Marianela, y queremos recordarla con su sonrisa, con sus ojos, su mirada. Espero que esta persona cumpla su condena. A pesar de que este juicio no fue por femicidio, creo que fue un femicidio, a Marianela la acosaba constantemente”, afirmó.
El primero en declarar ante el TOC 29 fue Matías, quien recordó el momento que ingresó al departamento de su hermana, donde arribó luego de que la joven no contestara durante dos días los llamados a su teléfono celular, y la encontró muerta.
También sostuvo que en ese momento atendió por el portero eléctrico a Amador, quien se presentó en el lugar y a quien le dijo que su hermana estaba muerta y había sido asesinada.
Al finalizar su declaración, con lágrimas en los ojos, Matías Rago Zapata se fundió en un abrazo con sus amigos y familiares.
Si bien Matías dijo que en ese momento no vio a Amador, Natalia Cavallo, pareja de Matías y quien también declaró hoy como testigo, aseguró que ella sí se lo cruzó en la puerta del edificio y que lo observó “nervioso”.
“Llegué al departamento y estaba Amador. Le pregunté a Amador por qué estaba ahí, le pregunté qué le había hecho. Fue una intuición que tuve, me pareció muy extraño que esté ahí abajo. No sabía que tenía una relación en ese momento, era muy extraño”, remarcó en su testimonial.
Por su parte, el padre de Marianela recordó un cruce que tuvo con su ex yerno cuando éste le levantó una vez la voz a su hija, que luego ocasionó que le pidiera disculpas.
“Creo que fue un ensañamiento con mi hija. Por dichos, me enteré que le estropeó una cena, de perseguirla a dónde iba, caerle de sorpresa a dónde ella estaba, de tratarla mal. Una persona así está mal”, sintetizó.
La jornada continuará el próximo lunes con el testimonio de tres testigos vía la plataforma virtual Zoom.
La escena del crimen
Marianela fue hallada asesinada el 28 de junio de 2010, cuando su hermano Matías fue a ver qué pasaba en el departamento 7mo. «A» que la chica alquilaba en la calle Tucumán 2080.
La estudiante yacía en el piso del living y, según la autopsia, murió degollada y quien la asesinó le aplicó además 23 puñaladas con una cuchilla que desapareció del cajón de la cocina de la casa.
El asesino también se llevó un juego de llaves, dos celulares, una notebook, un reproductor de MP3, otro de DVD y una cámara de fotos.
Entre 2013 y 2018, la jueza de instrucción Karina Zucconi sobreseyó a Amador en cinco oportunidades al creer que no había pruebas para incriminarlo y que en el departamento de la víctima se hallaron rastros del posible asesino -algunos ADN, una huella en una lata de gaseosa y una pisada-, que fueron cotejados con él y otros sospechosos, y en todos los casos el resultado fue negativo.
Finalmente, en 2018, la Sala VI de la Cámara del Crimen procesó a Amador en forma directa en base a una nueva data de muerte, al pasado violento del acusado y a lesiones que presentaba y podrían haber sido producidas por la víctima en su defensa.
Siempre se creyó que Marianela había sido asesinada durante la mañana del 27, cuando regresó del boliche, pero una Junta Médica estableció como nuevo horario del crimen el lapso entre las 19.10 de ese domingo y las 7.10 del 28.
Como posible móvil, la Sala VI indicó que el propio Amador «reconoció que, antes de romper su relación amorosa, tenían discusiones fuertes, sobre todo en el último mes», y que en su último encuentro con la víctima -tres días antes del crimen-, Marianela «le contó que salía con otra persona».
Amador llegó al debate en libertad y acusado de «homicidio simple» -con pena de 8 a 25 años de prisión-, ya que la figura del «femicidio» que se castiga con prisión perpetua, recién se incorporó al Código Penal a partir de 2013.
«Soy inocente, señores, no he cometido el crimen del que se me acusa», afirmó Amador al declarar en la primera audiencia del debate oral.
